Our services are intended for teachers and learners aged 13 and over, although they may be made accessible to all age groups. By using Brian, you confirm that your use of the service complies with all applicable laws and regulations and, if you are a minor, with the consent of your guardian.

2. Brian Account and Data

When you create an account on our platform, you are responsible for ensuring the security of your account and the associated data. You are responsible for all activities that take place under your account. Each account is for individual use by a single person and cannot be shared with others. Please notify Brian immediately if you notice any unauthorized use of your data, your account, or other security breaches. Brian cannot be held liable for any actions or omissions on your part, including damages resulting from such actions or omissions.

3. Subscription

Teachers can initially use Brian for free without providing a payment method. After the trial period, you can choose to subscribe. Subscriptions can be purchased by individual teachers or by institutions via a campus license.

Subscriptions automatically renew at the end of the respective period unless they are canceled before the current term expires. You can cancel your subscription at any time. We reserve the right to terminate your subscription at any time and without giving reasons. We may change subscription prices from time to time and will inform you of any changes in advance.

4. Premium Content

Some learners may have the right to purchase exclusive content from their teacher.

5. Use of Services, Responsibility of Learners and Teachers

In addition to the provisions of these General Terms and Conditions, the use of the services by learners and teachers is subject to the terms of the Acceptable Use Policy, available at [Link]. Violations of the provisions of the Acceptable Use Policy may lead to permanent exclusion from the platform.

6. Learning Analytics

Teachers are given access to learning analytics to improve the quality of teaching. However, this data must be used responsibly and ethically. Any misuse of learning analytics, such as the use for discrimination or other legal violations, is strictly prohibited. The primary and sole purpose of accessing this learning analytics is to improve education and outcomes for all learners.

7. License

Brian grants you a non-exclusive, limited license to use the services and our platform for the intended purpose and subject to these terms and conditions, as well as your compliance with the Acceptable Use Policy. All intellectual property rights relating to the services and the platform remain with Brian.

All content made available to you through the platform remains your intellectual property and Brian will not share it without your consent.

8. Trademarks

The Brian brand and logo are registered trademarks and may not be used without the express consent of Brian.

9. Individual Conditions

These General Terms and Conditions do not apply if we have individually agreed on other conditions.

10. Jurisdiction

These terms and your use of the platform are subject to substantive Swiss law, excluding conflict of law provisions. The place of jurisdiction for all disputes is St. Gallen, Switzerland, although we hope to resolve all issues amicably before legal action becomes necessary.
