Acceptable Use Policy

ContactThis Acceptable Use Policy applies to the use of the services provided by Brian AG (“Brian”), including the “Brian.study” platform, by students and teachers. Its aim is to ensure the responsible, safe, and lawful use of Brian and artificial intelligence.
This Acceptable Use Policy forms part of the usage agreement together with the General Terms and Conditions. Terms used in this policy are to be interpreted in accordance with the General Terms and Conditions. Brian reserves the right to amend this Acceptable Use Policy in accordance with the General Terms and Conditions and in compliance with any applicable legal requirements.
1. Conduct on Brian
Students and teachers may use Brian only within the scope of the contractual agreement and granted rights. Excessive use, or use that restricts or prevents others from using the platform, is prohibited. Use is only permitted in accordance with applicable legal regulations. In particular, users are expected to:
- behave ethically, including in the choice of usernames and interactions in discussion forums; this includes refraining from aggressive, offensive, racist, or sexist behavior;
- refrain from posting advertisements, spam, or inappropriate content, including pornographic, violence-glorifying, discriminatory, or offensive material, or content that may endanger the moral integrity or well-being of children or adolescents, or that may damage Brian’s reputation;
- refrain from any actions intended to misuse, manipulate, copy, decompile, or reverse engineer Brian’s software (including source code, algorithms, or AI systems), or to extract trade secrets;
- avoid any usage that infringes on Brian’s or third parties’ intellectual property rights or other rights, or that exposes Brian or third parties to liability, harm, or risk;
- refrain from providing or using malware, viruses, or other harmful software.
This list of prohibited uses is not exhaustive.
2. Protection of Intellectual Property Rights
Teachers are solely responsible for all content they use and provide when using the platform. Only content for which the teacher holds the appropriate rights, and which does not violate intellectual property rights—particularly copyright—or other third-party rights, should be uploaded to the platform.
In cases of doubt, the teacher is responsible for verifying their right to use the content. Ownership or possession of copies of certain materials (e.g., textbooks) does not automatically imply the right to use them on the platform.
3. Handling of Personal Data
Although all data on Brian is securely stored and not processed for AI training purposes, teachers must adhere to the principles of Privacy by Design and Privacy by Default when dealing with personal data. This means that only data strictly necessary for the specific educational purpose should be used. The use of personal data must be minimized in order to ensure the best possible protection of everyone’s privacy—especially that of the students.
